These Terms and Conditions are the legal agreement between you and The Tax-Free Plan governing your use of thetaxfreeplan.com, our educational materials, and any scheduled consultations.

The content on this site is for educational purposes only and is not investment, tax, or legal advice. No advisory relationship is created until a separate written agreement is signed.

1. Acceptance of Terms

These Terms and Conditions (the "Terms") are a binding agreement between you ("you," "your," or "User") and The Tax-Free Plan ("The Tax-Free Plan," "we," "us," or "our").

These Terms govern your access to and use of the website located at thetaxfreeplan.com, all subdomains and related landing pages, any educational materials you download (including the Roth Conversion Success Kit, Roth Conversion Guide, Custom Tax Impact Report, and Roth Conversion Optimizer), any surveys you complete, any strategy calls you book, and any other interactions initiated through the site (collectively, the "Services").

By accessing the Services, submitting a survey, requesting materials, or scheduling a consultation, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

2. Who We Are

The Tax-Free Plan is an educational platform focused on retirement tax strategy, Roth conversions, and tax-efficient retirement income planning. The content on thetaxfreeplan.com is educational in nature and is published for general informational purposes.

Where a strategy call or consultation leads to a formal, written advisory engagement, advisory services are provided through the appropriate licensed representative and/or registered entity and only after execution of a separate written agreement. Nothing on this site, in our materials, or during an initial consultation creates such an engagement.

3. Eligibility

  • Age and residence — you must be at least 18 years old and a legal resident of the United States
  • Intended audience — our materials are designed primarily for pre-retirees and retirees (typically ages 55–75) with qualified retirement assets, though we do not refuse general educational access
  • State limitations — certain offerings may be limited by state of residence based on applicable securities or insurance licensing
  • Accurate information — by using the Services, you represent that the information you provide is accurate, current, and complete

4. What We Provide

Through the Services, we may provide (at our discretion):

  • Free educational content about Roth conversions, retirement tax strategy, Social Security, sequence-of-returns risk, and related topics
  • The Roth Conversion Success Kit and related downloadable materials (collectively, the "Materials")
  • Optional surveys that qualify interest and capture background information used to personalize follow-up
  • Calendar-based scheduling for complimentary strategy calls
  • Tools and calculators (e.g., Roth Conversion Optimizer)
  • Automated and AI-assisted follow-up by email, SMS, and outbound voice calls

We may add, change, or discontinue any part of the Services at any time without notice. Materials are provided for your personal, non-commercial use.

5. No Advice, No Advisory Relationship

The information and Materials on thetaxfreeplan.com — including articles, videos, charts, tools, calculators, guides, reports, examples, and statements made during free strategy calls — are for general educational and informational purposes only.

Nothing on this site or in our Materials constitutes investment advice, tax advice, legal advice, insurance advice, accounting or estate planning advice, or an offer to enter into an advisory, brokerage, or insurance relationship.

A formal advisory relationship begins only when you and The Tax-Free Plan (or an affiliated registered entity or licensed representative) sign a written advisory agreement. Until that happens, no fiduciary duty and no client relationship is created by your use of the Services.

Forward-Looking Statements

Any projections, illustrations, calculators, examples, or scenarios shown on the site or in the Materials are hypothetical and for illustrative purposes only. They are not guarantees of future results. Actual results will vary based on tax-law changes, market performance, timing, your personal circumstances, and assumptions used.

Not an Offer Where Prohibited

The Services are not intended for distribution to, or use by, any person or entity in any jurisdiction where such distribution or use would be contrary to applicable law or regulation. You should consult your own qualified tax advisor, attorney, CPA, and/or licensed investment professional before making any decision based on information obtained through the Services.

6. Appointments & Strategy Calls

You may book a complimentary strategy call. By booking, you agree that:

  • The call is exploratory and educational and may lead to a subsequent engagement only if both parties agree in writing
  • We may record calls for quality assurance, training, and compliance purposes — notify us at the start of the call if you do not consent
  • We may use limited information you provide (including survey responses) to personalize the discussion
  • We reserve the right to decline, reschedule, or terminate any call at our discretion
  • No advisory relationship is formed by scheduling or attending a call

7. Communications Consent

By providing your contact information via a survey, form, calendar booking, or other submission, you expressly consent to receive communications from The Tax-Free Plan at the email address and/or phone number you provide, including:

  • Transactional messages — appointment confirmations, reminders, delivery of requested Materials, follow-ups related to your inquiry
  • Educational and marketing communications — related to retirement tax strategy, Roth conversions, and related topics
  • Outbound voice calls — including calls placed by automated systems or AI voice assistants on our behalf
  • SMS / text messages — subject to the SMS Program Terms below

Consent to receive marketing communications is not a condition of any purchase or of receiving requested Materials. You may opt out of marketing communications at any time by replying STOP to any SMS, clicking unsubscribe in any marketing email, or emailing [email protected]. Transactional messages related to an active appointment may continue even after a marketing opt-out.

8. SMS Program Terms (A2P 10DLC)

SMS Program Terms

Program: The Tax-Free Plan — Roth Conversion Follow-Up. Purpose: appointment reminders, delivery of requested Materials, and educational follow-up related to your inquiry. Message frequency varies; typically no more than a few messages per week. Msg & data rates may apply — your carrier, not The Tax-Free Plan, is responsible for those charges.

Reply STOP to any message to unsubscribe. Reply HELP for help. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.

SMS Consent

By providing your phone number and submitting a form on thetaxfreeplan.com, you expressly consent to receive SMS text messages from The Tax-Free Plan. Consent is not a condition of receiving any service or product. You may withdraw your consent at any time by replying STOP.

9. AI Voice Assistants

You may receive outbound phone calls from The Tax-Free Plan that are initiated by AI voice assistants (including agents named "Emma" and "James"). These calls qualify your interest, confirm information you provided in a survey, and help you schedule a strategy call with a human advisor.

  • AI voice calls will identify themselves as AI-assisted when asked, and will transfer to a human when requested
  • Calls may be recorded and transcribed for quality assurance, training, and compliance purposes
  • You can opt out of future AI outreach at any time by saying "remove me" during the call or by contacting [email protected]
  • AI-generated conversation is not advice and does not form an advisory relationship

10. Information You Provide

When you use the Services, you may provide information such as your name, email, phone number, age range, retirement assets, state of residence, and goals. You represent that such information is accurate and that you are authorized to provide it. We use this information to deliver Materials, personalize follow-up, schedule calls, and improve the Services, as described in our Privacy Policy.

11. User Conduct

You agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms
  • Submit false, misleading, or fraudulent information
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the Services, servers, or networks (including by transmitting malware or by scraping, crawling, or harvesting content)
  • Attempt to reverse-engineer, decompile, or derive source code from any tool or calculator on the site
  • Reproduce, distribute, or create derivative works from the Materials for commercial purposes without our written permission

12. Intellectual Property

All content on the Services — including text, graphics, logos, images, videos, templates, calculators, the Roth Conversion Success Kit, and the underlying compilation and code — is owned by The Tax-Free Plan and/or its licensors and is protected by United States and international copyright, trademark, and other intellectual-property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Services and download the Materials for your personal, non-commercial use. All other rights are reserved.

The Tax-Free Plan™ and Roth Conversion Success Kit™ are trademarks used by The Tax-Free Plan. Use of these marks without our prior written permission is prohibited.

13. Third-Party Links & Services

The Services may contain links to third-party websites, tools, or services (for example, calendar booking, SMS delivery, payment processing, or video conferencing). Those third parties operate under their own terms and privacy policies. We are not responsible for their content, availability, or practices. Linking is not endorsement.

14. Disclaimers of Warranties

THE SERVICES AND MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, THE TAX-FREE PLAN DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR UNINTERRUPTED OPERATION.

We do not warrant that information or Materials will be error-free, current, or suitable for your individual circumstances. Tax laws change frequently and may not be reflected in published content. Your use of the Services is at your own risk.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE TAX-FREE PLAN, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST TAX BENEFITS, LOST INVESTMENT RETURNS, OR LOST DATA — ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR MATERIALS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability arising out of or relating to these Terms or the Services will not exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless The Tax-Free Plan and its officers, employees, agents, and contractors from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or related to (a) your use of the Services, (b) your breach of these Terms, (c) your violation of any law or third-party right, or (d) information you submit to us that is inaccurate, misleading, or fraudulent.

17. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review it to understand how we collect, use, and protect your information.

18. Modifications

We may modify these Terms at any time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after the effective date of any modification constitutes your acceptance of the updated Terms.

19. Termination

We may suspend or terminate your access to the Services, in whole or in part, at any time and for any reason, including breach of these Terms. Upon termination, the sections of these Terms that by their nature should survive (including Sections 5, 11–16, 20, 21, and 22) will survive.

20. Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws principles. Subject to Section 21, any action or proceeding arising out of or relating to these Terms will be brought exclusively in the state or federal courts located in Beaufort County, South Carolina, and you consent to the personal jurisdiction and venue of those courts.

21. Dispute Resolution & Arbitration

Please read this section carefully. It affects your legal rights.

Except for disputes in which either party seeks injunctive or other equitable relief for the alleged unlawful use of intellectual property, any dispute arising out of or relating to these Terms or the Services will be finally resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in effect at the time the arbitration is initiated. The arbitration will be conducted in Beaufort County, South Carolina, or by remote means at the parties' election.

Class-Action Waiver

You and The Tax-Free Plan agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, representative, or consolidated proceeding.

30-Day Opt-Out

You may opt out of this arbitration agreement by sending written notice to [email protected] within thirty (30) days of first accepting these Terms. Your notice must include your full name, email, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.

22. Miscellaneous

  • Entire agreement — these Terms, together with the Privacy Policy and any separately signed agreements, constitute the entire agreement between you and The Tax-Free Plan regarding the Services
  • Severability — if any provision is held unenforceable, the remaining provisions will remain in full force and effect
  • No waiver — our failure to enforce any right is not a waiver of that right
  • Assignment — you may not assign these Terms without our prior written consent; we may assign these Terms freely
  • Headings — section headings are for convenience only and have no substantive effect
